What Is COIDA Services?
Compensation for Occupational Injuries and Diseases Act
The main objective of the Act according to cfoline.labour.gov.za is to provide compensation for employees that die or become disabled because of injuries or diseases they got from doing their job.
Who Can Claim Compensation Under The Act
If you are employed with a contract of service and get a weekly or monthly salary or wages can claim from the compensation fund.
If an employee is fatally injured then their dependents can claim compensation.
Note that full-time employees and casual employees’ rights are the same.
Compensation You Can Expect
The compensation you can receive is money to replace the loss of your salary/wages or to pay medical expenses because you were injured on duty.
You will not get compensation if you are off work for 3 days or less but your medical expenses will still be paid.
For the first three months you are booked off from work, your employer is obliged to pay you 75% of your earnings/wages as at the time of the accident, if your injury is serious and lasts for the first three months.
From the day of your injury on duty, your employer should pay 75% of your wages for the first 3 months if your injury is serious and lasts the period.
Your employer can claim back this compensation from the Compensation Fund.
In the case where your injury lasts more than 3 months where you are unable to work, the money for your wages or salary should be claimed directly for the Compensation Fund.
